Apollo Tyres Ltd. (referred to as “ATL”, “we” or “us”) respects your privacy and is committed to protecting it. This Website Privacy Notice (referred to as “Privacy Notice”) extends to extends to ATL's subsidiaries/joint ventures, lower-tier subsidiaries and affiliates (including its European entities).

This Privacy Notice explains how ATL will collect, use and share your personal information as data controller when you (or your company) purchase our products/services or provides products/services to us, subscribe to our newsletter or any other information you provide to us when you visit our website. The Privacy Notice is aimed to assure you, that in instances wherein you share your personal information with ATL, it is duly protected in accordance with the applicable laws.

To register and create an account on the website and provide you with our products/services:

  • If you are a natural person, it is necessary for us to process your personal information to perform our contract with you, or to take steps at your request prior to entering into a contract with you. 
  • If you are acting on behalf of your company, we have a legitimate interest in processing your personal information in order to provide you or your company with the products/services requested.

To manage our relationship with you: we have a legitimate interest in managing our business and providing our products/services to you or your company.

To process payments, billing and collection:

  • If you are a natural person, it is necessary for us to process your personal information to perform our contract with you, or to take steps at your request prior to entering into a contract with you.
  • If you are acting on behalf of your company, we have a legitimate interest in processing your personal information to process the request made by you.

To establish, exercise or defend legal claims or to comply with orders or requests of relevant courts or regulators: we have a legitimate interest in processing your personal information to establish, exercise or defend a legal or equitable claim. Furthermore, we might have a legitimate interest/legal obligation to comply with applicable local laws.  

4.2) Processing of personal information during promotional campaigns

To send you direct marketing communication by emails:

  • New customers/subscribers: we process your personal information on the basis of consent.
  • Existing customers: we have a legitimate interest in sending direct marketing by email to our existing customers about similar products/services, if allowed under applicable local laws.
 

When we have a legitimate interest to process your personal information. Our legitimate interest will vary depending on what we are processing your data for, and we explain above what the interest is and how it relates to the processing operations that we are carrying out. Where we process personal information on the basis of a legitimate interest, we will carry out a balancing test to document our interests, to consider what the impact of the processing will be on you and to determine whether your interests or fundamental rights and freedoms outweigh our interests in the processing taking place. 4.3) Processing of Log information, cookies and web beacons

The Website collects standard Internet log information including your IP address, browser type and language, access times and referring website addresses. To ensure that the Website and Communications are well managed and to facilitate improved navigation, we may also use cookies (small text files stored in a user's browser) or web beacons (electronic images that allow us to count users who have accessed content and to access certain cookies) to collect aggregate data. The information above will be used in an aggregated form (i.e. so that it cannot be traced back to you) to help us create, develop, operate, deliver, and improve our products and services.

5. SHARING YOUR INFORMATION

If necessary to provide a product/service you request from us, reach out to us, when you complete a form on our website or to follow up on your enquiries, we share your information with other ATL entities or third party service providers, for example by email and or via hosting providers, suppliers and customer support service providers. Third party service providers will process your information on behalf of ATL for the purpose above. When we share your data with these parties, we make sure that appropriate safeguards are taken to protect your information (e.g. by entering into a data processing agreement, including technical and organisational (security) measures).

We have ATL entities, and some partners or service providers located outside of the European Economic Area (“EEA”), in particular India and the countries in which ATL has an office such as United States, Switzerland, the UK, South Africa, Malaysia, Singapore, Indonesia, Thailand and the United Arab Emirates. Where appropriate, we rely on various additional data protection measures in order to secure the transfer of your personal information such as adequacy decisions of the European Commission (read more here), such as those related to the United States of America (commercial organisations participating in the EU-US Data Privacy Framework), the United Kingdom, and Switzerland, and the Standard Contractual Clauses as issued by the European Commission (read more here) (in most cases we use module 1 – controller to controller and module 2 – controller to processor) and the Binding Corporate Rules that some of our suppliers have adopted (read more here).

Website metrics for this website may be shared with other Apollo groups, subsidiaries or affiliates. The shared information will be aggregated data and will not include any of your personal information. Please refer to our Cookie Notice for more information.

9. YOUR RIGHTS

a) Access – You can ask us to verify whether we are processing personal information about you, and if so, to provide more specific information.

b) Correction – You can ask us to correct our records if you believe they contain incorrect or incomplete information about you.

c) Erasure – You can ask us to erase (delete) your personal information after you withdraw your consent to processing or when we no longer need it for the purpose it was originally collected.

d) Right to Restrict to the Processing – You can restrict to our use of your processing your personal. 

e) Right to Object to the Processing, including Direct Marketing – You can object to our use of your personal information for processing (in particular, where we don’t have to process the data to meet a contractual or other legal requirement), including direct marketing purposes. We may need to keep some minimal information to comply with your request to cease marketing to you (e.g. your preference that you don’t want to receive any marketing communication anymore).

f) Right to Withdraw Consent – You can withdraw your consent that you have previously given to one or more specified purposes to process your personal information. This will not affect the lawfulness of any processing carried out before you withdraw your consent. It may mean we are not able to provide certain products or services to you and we will advise you if this is the case. g) Right to transfer of information – You have a right to transfer your information to a different service provider.

These rights may be limited, for example if fulfilling your request would reveal personal information about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep. 

We may need to request specific information from you to help us confirm your identity and ensure your right to access the information or to exercise any of your other rights. This helps us to ensure that personal information is not disclosed to any person who has no right to receive it. No fee is required to make a request unless your request is clearly unfounded or excessive. Depending on the circumstances, we may be unable to comply with your request based on other lawful grounds.

Where we collect personal information to administer a contract directly with you, to take steps to enter into a contract with you, or to comply with our legal obligations, this is mandatory and we will not be able to manage the relationship with you without this information. In all other cases, provision of the personal information is optional, but this may affect your ability to communicate with us where the information is needed for those purposes.
